1. WORK VISAS

For lawfully operating Australian and Overseas employers, to employ approved skilled workers for vacancies in particular occupations required in Australia. Australian Employers can sponsor overseas skilled workers in particular occupations required in Australia on a temporary or permanent basis. There are a variety of working visas (Subclass 482, and subclass 186) are the most popular visas in this area.

482 TSS – Work Visa

The 482 Visa is the standard work visa for overseas nationals. This is a temporary visa for 2- 4 years. Dependent family members can be included in their application. New Pathway for TSS visa holders with occupations in the short-term list to 186 TRT stream that remained in Australia during the COVID19 pandemic for at least 12 months from 1Feburary 2020 to 14 December 2021  

Employer Nomination Scheme (subclass 186) and Skilled Employer Sponsored Regional (Provisional) visa (subclass 494)

This is a permanent residence visa for skilled workers. You must be nominated by an Australian Employers. Dependent family members can be included in their application. Again, here your occupation needs to be on the specific occupation list), and you must have the relevant qualifications and work experience to match. Training visa (subclass 407 

              This visa allows people to take part in workplace-based training to improve their skills for their job, area of tertiary study, field of expertise or in a                 professional development training program in Australia.

           There are 3 types of occupational training covered by this visa:

      Nomination is the stage where the sponsor provides details about the nominee (intended trainee), the purpose or type of training and how and                      where the training will be provided.

2. SKILLED VISA (SC 189/190 visas)

       There are two categories here.

  • Independent General Skill Migration
  • Nominated General Skilled Migration
  • New Zealand Stream 
  • Hong King Stream 

This is for people who are not sponsored by an employer and who have skills in particular occupations required in Australia. Dependent family members can be included with the main applicant in most cases. These are points tested visas. 

If you are under 45 years of age and have an occupation which is listed on the Skilled Occupation List (SOL) (see Migration (LIN 19/051: Specification of Occupations and Assessing Authorities) Instrument 2019 (legislation.gov.au) and have the relevant qualifications and work experience to match, then it is most likely you will qualify for a General Skilled Migration (GSM) visa. Please note in some cases depending on the occupation you may qualify for this visa without formal qualifications if you have evidence of years of experience to match.

You must have the relevant qualifications and work experience to match and will need to be sponsored by a State or Territory Government. To be sponsored by a State or Territory Government, your occupation must also be listed on the relevant state occupation list. Migration (LIN 19/051: Specification of Occupations and Assessing Authorities) Instrument 2019 (legislation.gov.au). You could also be sponsored by a relevant family member too to be eligible for this visa.

For the New Zealand Stream you should hold a 444 visa and lived in Australia for at least 5 years and satisfy the income test requirement. 

For the Hong Kong Stream you must hold a Hong Kong passport or a British National (Overseas) passport, and meet certain visa and residence requirements

 3. PARTNER VISA

There are two different options

  • Prospective Marriage Visa
  • Spouse Visa

You may be eligible for a partner category visa if you are:

  • Spouse of an Australian citizen, Australian permanent resident or eligible New Zealand citizen, or
  • Fiancé of an Australian citizen, Australian permanent resident or eligible New Zealand citizen, or
  • De facto partner (including same-sex relationships) with an Australian citizen, Australian permanent resident or eligible New Zealand citizen.

Your partner can be in Australia or overseas at time of application for a Partner visa. You can be married, engaged, or in a de facto relationship.

4. PARENT VISA

There are age requirements for this visa.

There are a few options, but the quickest one is if you have enough money to pay towards your future medical and assurance of support in Australia. You may be eligible to apply for a parent category visa if:

    • You have a child who is
      • An Australian citizen, an Australian permanent resident, or an eligible New Zealand citizen, and
      • Your child has been living in Australia lawfully for at least 2 years before you lodge your visa application
    • You have a sponsor
    • At least half of your children live permanently in Australia, or
    • More of your children live permanently in Australia than in any other country.
    • You meet health and character requirements.
