3. Business Visas

There are many investment visas for business owners who genuinely want to invest and do a business in Australia. You may need to meet age, English and financial requirements. You will need to contact us for further information on this.

Significant Investor stream (subclass 188) 5 Million investment visa

This is the easier and quicker option if you have 5 million to invest in complying investment in Australia. Here there is no age or English language requirements.

This is for business owners. It’s a 4 year temporary residency visa. You do not need to live in Australia for the entire duration of your visa.

There are a few stages prior to obtaining this visa. It can be very complex and needs the expertise of a few professional in different areas to make sure all requirements are met in order to acquire this visa.

The stages are:

  • Expression of Interest for this visa
  • Nominated by a state or territory government
  • Invited to apply for this visa

Once the visa is granted you need to comply by;

  • residing in the state or territory whose government agency nominated you,
  • continue your business and investment activity in Australia after the conclusion of your provisional visa,
  • live in Australia for at least 40 days per year (calculated cumulatively) for the duration of your provisional visa, or your spouse to live for at least 180 days per year (calculated cumulatively) for the duration of your provisional visa.

The investment will have to be made prior to visa grant not at time of visa application being lodged.

The new complying investment framework for the SIV programme is spread over a few different areas.

After 4 years on a 188 visa you can apply for permanent residency through a subclass 888 visa
You can apply for the 888 after you have fulfilled the requirements of your provisional visa.

Please note – You need to be able to prove that the assets or funds you use for your complying investment are unencumbered and lawfully acquired. When you apply for a Significant Investor or Premium Investor visa you will need to provide a statement that identifies your ownership as well as the value of assets that you want to use to fund your complying investments. The value of these assets must be a minimum of AUD5 million for the Significant Investor visa

The value of your complying investment must be at least AUD5 million at the time a decision is to be make on your visa. When you have been granted a visa, it does not matter if your complying investment falls below AUD5 million. The value of your complying investment could fall below or go above AUD5 million. If you withdraw your complying investment while holding the visa, you will need to reinvest it into another complying investment within 30 calendar days. If you do not do this, you will be in breach of your visa condition 8557 and your visa could be cancelled.
